Sale and delivery

The following sales- and delivery terms are valid by sale from flora marketing aps.

The order

The offer is non-committal unless something else is written in the offer.

The order confirmation will be send at the customers request before dispatch of the goods or starting the production. The sales agreement and the prices are binding according to the order confirmation. Still we make reservations for exchange rates, duties and taxes until date of delivery. The invoice will be send by mail by delivery of the goods.

Delivery

flora marketing aps delivers the goods at an address decided by the customer at the expense and risk of the customer unless something else appears from the order confirmation. When delivering, flora marketing is not responsible for delays due to circumstances by the sub-supplier of flora marketing aps.

Over- and under delivery: By individually manufactured products flora marketing reserves the right to over- and under delivery by up to +/- 10% of the agreed quantity.

Payment

Payment and time for payment is 30 days net unless something else is stipulated in the order confirmation. This will also appear from the invoice.

Complaint

The customer must make a complaint to flora marketing as soon as a fault or a defect has been detected. Flora marketing will then remedy or re-deliver. Only goods on stock can be returned and only after foregoing agreement about repurchase.

According to the provisions of the Sale of Goods Act it is possible to complaint within 2 years after the purchase.

Product liability

flora marketing aps is not responsible for personal injuries or damages on things if they are caused by a product, of which flora marketing is only a dealer. Flora marketing is only responsible for personal injuries if the injured person can prove that the injury is due to faults or negligence on the part of flora marketing or another person for whom flora marketing is responsible.

Force Majeure

If the following incidents happen after entering an agreement, and the incident hinders the keeping of the agreement, flora marketing has no responsibility:

Labour conflict, strike, lockout, boycott and any circumstance of which the parties are not in control such as fire, war, mobilization or unforeseen national service of similar dimensions, confiscation, currency restrictions, riot, public regulations, theft, lack of  means of transport, general scarcity of goods, sub-suppliers restrictions due to Force Majeure.
